Year 2 Learning Objectives
* Identify when the duty to preserve evidence arises, manage preservation letters, and understand the legal and strategic consequences of spoliation in CMV claims.* Plan and manage key depositions with defense counsel, determine who to depose and when, and prepare for plaintiff-led depositions in complex transportation litigation.
* Understand how FMCSA rules influence claim exposure, litigation strategy, and defensibility in truck accident cases.
* Recognize risks in driver qualification files and personnel management, and prepare defensible responses to common allegations.
* Utilize basic and advanced reconstruction techniques—including crash data and expert analysis—to assess liability and causation in truck accident claims.
* Identify Reptile tactics early, prepare company witnesses effectively, and develop proactive defense strategies to mitigate jury manipulation.
* Develop early resolution plans, apply mediation tactics specific to transportation claims, and strategically use evidence like ECM data to drive outcomes.
* Interpret IME results, assess long-term injury value, and analyze medical and economic factors to support injury claim evaluations.
